Welcome to the terms and conditions ("Terms") for the All-Year Dining Pass. on.name}} website, all of which (as changed over time) are incorporated into these Terms. If you sign up for an All-Year Dining Pass membership, you accept these terms, conditions, limitations, and requirements.

Permissions


By signing up, you agree to receive an email or text reminder to cancel three days before automatic annual renewals. You agree to register each All-Year Dining Pass with a unique name, email, and mobile number to get welcome messages and login credentials. Sharing personal details is prohibited. You consent to SMS or emails as provided, with applicable rates. Privacy is a priority; unsubscribe anytime via the link in our messages.

How It Works

All-year Dining Pass valid, weekly $25 credit is valid for dine-in only for one year from the date of purchase to max 52 times or $1,300 in promotional value—present All-Year Dining Pass™ when placing your order for dine-in. Passes can be used up to 52 times, starting on the date of purchase for one year or up to $1,300. The pass may only be used once every week to redeem up to $25 for food and non-alcoholic beverages. No credit will be given for a missed redemption. There is no rollover if a single use is less than $25. Excludes tax, gratuity, alcohol, retail, gift cards and fees. Pass not valid through third-party delivery providers. No refunds are given after first use and three days after purchase, whichever comes first.

The promotional value of the purchase decreases weekly and expires 12 months from the date of purchase, regardless of validations. The amount paid also expires 12 months after purchase but decreases by $25 each time it is redeemed. The restaurant is responsible for its goods and services' quality, care, and availability. Alcohol purchases require a valid ID and a minimum age of 21. A limit of two passes per table applies. All Year Dining Passes, except birthday desserts and anniversary gifts, cannot be used with other offers, discounts, or specials. The All Year Dining Pass is not a gift card, and the promotional value cannot be exchanged for cash.

The birthday dessert and anniversary gifts can be redeemed once a year during your birthday and anniversary months, with automatic renewal every 12 months from the activation date. The "Kids Eat Free" promotion is available for every adult entrée purchased at regular price, valid during business hours, and instantly renewed with each use. Moreover, enjoy a $25 weekly online credit for orders of $50 or more, which renews every Monday for up to 52 weeks, totaling a value of $1,300 after your purchase date. Benefit from exclusive perks like priority reservations, special event invitations, access to unique menu specials, surprise promotions, opportunities to support school fundraising, and the potential to earn extra income through our affiliate program—all delivered straight to your inbox or mobile device. Additionally, please take advantage of member discounts at various hotels, retailers, attractions, ticket outlets, and primary care providers, courtesy of our esteemed partners.

Gratuity

A 15% gratuity is added to your original bill before applying $25 credits. However, sales tax is applied to the remaining balance after this credit, reducing your sales tax liability. This approach supports our exceptional servers, ensuring they can continue to provide excellent service as you enjoy your $25.00 weekly credit for food and non-alcoholic beverages and other benefits year after year. Your final bill will clearly show if gratuity has been included, and while not required, additional tips are always appreciated for exceptional service. After validating each coupon pass, your next $25 All-Year Dining Credit will automatically renew in seven days.

Membership Cancellation

Should you opt to cancel within three days of subscribing or moving from a free trial to a paid membership, a full refund of your membership fee will be issued only if neither you nor your account have made any eligible purchases or utilized All-Year Dining Pass benefits since the last charge for your dining pass membership. Otherwise, your membership will be terminated before the next renewal cycle. If your All-Year Dining Pass membership was acquired through a third party, you may need to reach out to them to cancel it or obtain any applicable refund based on their respective policies. Memberships redeemed via gift or promotional codes are ineligible for refunds.

Other Limitations


We reserve the right to accept or refuse membership at our discretion. We may send you emails, texts, and other communications related to the All-Year Dining Pass and your membership (regardless of any settings or preferences related to your {{location.name}} account).

You may not transfer or assign your All-Year Dining Pass membership or any All-Year Dining Pass benefits, including promotion codes for All-Year Dining Pass memberships or benefits, except as allowed in these terms. All-Year Dining Pass members cannot use the benefits for commercial purposes. Some All-Year Dining Pass benefits may have certain purchase thresholds, quantity limitations, or requirements that members meet specified criteria to access them. From time to time, {{location.name}} may choose to add or remove All-Year Dining Pass membership benefits at its sole discretion.

Fees and Renewal


The All-Year Dining Pass membership fee is stated on our website's All-Year Dining Pass page. We may occasionally offer different membership terms, and the fees for such membership may vary. The All-Year Dining Pass membership fee is non-refundable except as expressly outlined in these Terms. Taxes may apply to membership fees and All-Year Dining Pass benefits charges. If you sign up for your All-Year Dining Pass membership through us and are billed by us, the billing terms described below will apply to your membership.

If all eligible payment methods on file for you are declined for payment of your membership fee, you must promptly provide us with a new eligible payment method, or your membership will be canceled, and renewing may not be possible due to limited capacity. If you provide us with a new eligible payment method and are successfully charged, your new membership period will be based on the original renewal date and not the date of the successful charge. If you signed up for your All-Year Dining Pass membership through a third party and are not billed directly by us, then the billing terms provided by the third party will apply to your membership.

If you don't inform us before a charge that you wish to cancel auto-renewal, you acknowledge that your All-Year Dining Pass membership will automatically renew. You will receive email and text reminders three days before the renewal charge. By agreeing to this, you authorize us to collect the current membership fee and any applicable taxes using any eligible payment method on file for you without further notice unless mandated by applicable law.


Promotional Trial and Qualification-Based Memberships


We sometimes offer specific customers various trial or other promotional memberships, subject to these Terms except as otherwise stated in the promotional offers. Trial members may at any time (through Your Account) choose not to continue to paid membership at the end of the trial period.


Agreement Changes



Without your notice, we may change these Terms, {{location.name}} 's Conditions of Use and Privacy Notice, or any aspect of the All-Year Dining Pass subscription. If any change to these terms is found invalid, void, or unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.MEMBERSHIP.


Termination by Us

We reserve the right to terminate your All-Year Dining Pass membership at any time, according to our discretion. If we do so, we will refund your annual fee, deducting $25 for each redemption made. If it's not possible to ascertain the total number of redemptions, we will issue a prorated refund based on the remaining months of your membership. However, we will not provide a refund if the termination is due to behavior that, in our assessment, violates these Terms or any applicable laws, involves fraud or misuse of the Dining Pass, or negatively impacts our interests or those of another user. Our failure to consistently enforce these Terms does not imply a waiver of our rights to do so in the future.


Limitation of Liability:

In addition to other limitations and exclusions in {{location.name}}'s Conditions of Use, our total liability, whether in contract, warranty, or tort (including negligence), will not exceed the last membership fee you paid. This limitation of liability will apply to the fullest extent permitted by law and will survive cancellation or termination of your All-Year Dining Pass membership.

Disputes:

Any dispute or claim relating to these terms or your use of the All-Year Dining Pass will be adjudicated in the state or Federal courts in
{{location.city}}, and you consent to exclusive jurisdiction and venue in these courts. We each waive any right to a jury trial.
